Course Learning Outcomes
On successful completion of this course, students will be able to:
1 Analyse the jurisdictional aspects of the military discipline law system. 2 Provide advice on complex military discipline law matters without supervision. 3 Apply an understanding of the relationship between the Defence Force Discipline Act 1982 (Cth)(DFDA), the Criminal Code Act 1995 (Cth) and the Criminal Code 2002 (ACT), and the defintion and scope of the 'territory offences', general defences and other applicable federal law, to solve practical problems arising in military legal practice. 4 Articulate the distinct phases of an investigation into an alleged disciplinary event, focusing on key concepts underlying arrest, search and seizure and interviewing; and the grounds for appeal. 5 Analyse the role of prosecutorial discretion in relation to the choice of charges, the elements of offences, possible defences that could be raised, and the sufficiency of admissable evidence; determine relevant punishments available under the DFDA, and selected Jervis 6 Undertake self-directed research into military discipline law matters. 最新糖心Vlog Graduate Attributes

The course will be taught intensively over 5 days with structured learning activities required to be completed in advance of the intensive classes. Details of the course structure will be published to students on MyUni in advance of the course, but cannot be confirmed at this stage pending negotiations with the Military Law Centre regarding their priorities for issues to be addressed in the course. -

Student presentation (30%) 10 minutes per student + written outline of argument
This assessment task involves several options:
(i) Individual/group
It may be a group or individual presentation. In group presentations, all group members will receive the same mark and each student must present for 10 minutes. The ‘presentation’ does not necessarily involve each student speaking for 10 minutes, but each student must be responsible for managing 10 minutes of time. For example, in a group of three students one student might speak on a topic for 10 minutes, one student might present a scenario for 10 minutes, and one student might moderate class discussion for 10 minutes. The allocation of tasks is a matter for the group to determine.
(ii) Topics
The topic of the presentation may be a) a particular case, b) a particular issue, or c) an overview of the research essay the student intends to undertake. There is no set list of issues or cases but there will be options of essay topics. The presentation must be related to a topical, controversial or significant matter related to disciplinary law. It may, but does not have to, relate to the topics covered in the course.
A written outline will need to accompany the oral presentation. Further instructions on the oral and written components will be provided on MyUni and discussed on the first day of the course.
Research Essay (70%) 5000 words
This assessment task involves a research essay on (i) a topic chosen and developed by the student, or (ii) chosen from a list of essay topics provided to reflect the content covered in the course. It is recommended that students seek approval of the topic by the course coordinator well in advance of the due date if they choose their own topic. Students will be required to demonstrate advanced level skills in research and critical analysis in a relevant field of military disciplinary law or a closely related area of civilian criminal law.

Finality of Assessment Grades
Students are advised that Course Coordinators will not enter into negotiations of any kind with any student regarding changes to their grades. It is irrelevant, in any given circumstance, that only a minimal number of additional marks are required to inflate a student’s grade for any individual assessment item or course as a whole. Pursuant to the 最新糖心Vlog’s Assessment for Coursework Programs Policyand the Adelaide Law School Assessment Policies and Procedures, grades may only be varied through the appropriate channels for academic review (such as an official re-mark).
Moderation
In accordance with the 最新糖心Vlog’s Assessment for Coursework Programs Policy, course coordinators ‘ensure that appropriate marking guidelines and cross-marking moderation processes across markers are in place’ in each course. Procedures adopted by Adelaide Law School to ensure consistency of marking in courses with multiple markers include:- assurance of the qualifications of markers, and their knowledge of the content covered in each course;
- detailed marking guidelines and assessment rubrics to assist in the marking of items of assessment;
- sharing of example marked assessments at various grade bands across markers;
- reviewing of selected marked assessments from each marker by the course coordinator;
- comparison of the marks and their distribution across markers;
- automatic double-marking of all interim assessment receiving a fail grade, and of final assessments where a student’s overall result is a fail grade;
- the availability of re-marking of assessments in accordance with Adelaide Law School’s Assessment Policies and Procedures.
Approval of Results by Board of Examiners
Students are reminded that all assessment results are subject to approval (and possible moderation/change) by the Law School’s Board of Examiners. Assessment results at the 最新糖心Vlog are not scaled. Under the Assessment for Coursework Programs Policy, students are assessed ‘by reference to their performance against pre-determined criteria and standards … and not by ranking against the performance of the student cohort in the course’. However, under that same policy, the Board of Examiners (as the relevant Assessment Review Committee for courses at Adelaide Law School) is required to ‘ensure comparability of standards and consistency’ in assessment. On occasions, the Board of Examiners will form the view that some moderation is required to ensure the comparability of standards and consistency across courses and years, and accordingly provide fairness to all law students. All assessment results are therefore subject to approval (and possible change) until confirmed by the Board of Examiners and posted on Access Adelaide at the end of each semester. -
Student Feedback

The course is constantly being updated and revised to reflect the evolution of the law, to respond to student feedback, and to engage with the latest teaching practices.
